Mauritius Virtual Assets and Initial Token Offering Services

The Virtual Assets and Initial Token Offering Services Act 2021 (The “Act”) came into force on the 7th February 2022.

This Act sets out a comprehensive legislative framework to regulate the business activities of Virtual Assets Services Providers (VASPs) and Issuers of Initial Token Offerings (IITOs) in Mauritius.

This framework is required to meet international Financial Action Task Force standards in respect of provisions for managing, mitigating and preventing any anti-money laundering and countering the financing of terrorism (AML/CFT) risks associated with these emerging business practices.

Virtual Asset is defined as a digital representation of value that can be digitally traded, or transferred, and can be used for payment or investment purposes but does not include digital representations of fiat currencies, securities and other financial assets that are already covered in the Securities Act 2005.

Initial Token Offerings (ITO) is defined as an offer for sale to the public, by an issuer of initial token offerings, of a virtual token in exchange for fiat currency or another virtual asset.
